These Website Terms of Use (“Terms”) govern your access to and use of the Criterion RV Verification website, customer portal, staff-access features, online forms, and related digital services collectively referred to as the “Website.”
In these Terms, “Criterion,” “we,” “us,” and “our” mean Criterion RV Verification. “You” means any person who visits or uses the Website.
By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website.
1. Website Purpose
The Website provides information about Criterion’s RV inspection, RV scouting, buyer-verification, condition-monitoring, fluid-analysis, and related services. It may also allow you to:
- Request a service
- Review a quote
- Sign documents
- Make a payment
- View appointment information
- Access inspection records and reports
- Communicate information needed to perform a service
Website content is provided for general informational and administrative purposes. Website content is not itself an RV inspection, inspection report, engineering opinion, mechanical diagnosis, appraisal, warranty, safety certification, title search, legal opinion, insurance opinion, or guarantee of an RV’s condition or future performance.
2. Service Requests Are Not Confirmed Appointments
Submitting an online request does not:
- Create an inspection contract
- Confirm an appointment
- Guarantee availability
- Guarantee a particular price, scope, completion date, or report-delivery date
- Confirm that an RV, location, or requested service is suitable for inspection
Criterion must separately review and confirm the requested service, scope, access, location, timing, price, and applicable documents.
An appointment is not confirmed until Criterion provides confirmation and all required prerequisites have been satisfied.
3. Inspection Agreements Control
RV inspections and other paid services may require a separate:
- Quote or service proposal
- Pre-Inspection Agreement
- Standards of Practice
- Scope statement
- Payment authorization
- Subscription or condition-monitoring agreement
- Other service-specific document
Those documents govern the actual service.
If these Website Terms conflict with a signed service agreement, the signed service agreement controls with respect to that service.
Nothing on the Website expands an inspection scope or overrides an exclusion, limitation, condition, or responsibility stated in the applicable agreement or Standards of Practice.
4. Customer Responsibilities
You agree to provide information that is accurate and complete to the best of your knowledge.
You are responsible for:
- Identifying the correct RV and service location
- Providing accurate contact, vehicle, access, and deadline information
- Obtaining authorization for Criterion to access and inspect the RV
- Coordinating access with the owner, seller, dealer, storage facility, repair facility, or other responsible party
- Disclosing known access restrictions, hazards, damage, modifications, disconnected utilities, or inoperative equipment
- Ensuring that requested utilities and systems are available when required by the agreed scope
- Reviewing quotes, agreements, appointment details, and reports promptly
- Protecting portal access links, downloaded reports, and account information
Criterion may rely on information supplied by you or by people you authorize.
5. No Purchase, Title, Value, or Transaction Advice
Criterion is independent of the sale or negotiation of an RV unless a written agreement expressly states otherwise.
Criterion does not determine or guarantee:
- Ownership or legal title
- Lien status
- Vehicle history
- Market value
- Financing eligibility
- Insurance eligibility
- Seller representations
- The advisability of purchasing, selling, repairing, or retaining an RV
You remain responsible for purchase, title, lien, history, valuation, financing, insurance, contract, and payment due diligence.
6. Portal and Account Security
Some Website features require authentication or a secure sign-in link.
You agree to:
- Use only accounts and records you are authorized to access
- Keep sign-in links, email accounts, and devices secure
- Notify Criterion promptly of suspected unauthorized access
- Avoid sharing portal materials with unauthorized persons
- Log out of shared devices when appropriate
You are responsible for activity performed through access credentials under your control, except to the extent caused by Criterion’s failure to exercise legally required care.
Criterion may suspend access when reasonably necessary to investigate security concerns, protect records, comply with law, or prevent misuse.
7. Electronic Communications and Signatures
You consent to receive documents, notices, disclosures, quotes, agreements, receipts, and other communications electronically when you interact with the Website or provide an email address for that purpose.
Electronic signatures and records may be used for applicable transactions. You are responsible for reviewing documents before signing them and retaining copies for your records.
You may contact Criterion before signing if you cannot access or review an electronic document.
8. Payments and Subscriptions
Payments may be processed through Stripe or another disclosed payment provider.
Criterion generally does not receive or store your complete payment-card number or bank-account credentials. Payment providers process that information under their own terms and privacy policies.
Prices, deposits, payment schedules, recurring charges, cancellation terms, refunds, credits, and payment disputes are governed by the applicable quote, signed agreement, subscription terms, or other service-specific document.
Starting a recurring condition-monitoring plan authorizes the recurring charges disclosed during checkout until the plan is canceled in accordance with the applicable service terms.
You agree not to initiate a payment dispute based solely on matters already resolved according to an applicable signed agreement. Nothing in these Terms limits rights that cannot lawfully be limited.
9. Information and Materials You Submit
You may provide notes, photographs, documents, vehicle information, access instructions, recordings, or other materials through the Website or directly to Criterion.
You represent that:
- You have the right to provide the materials
- Providing them does not violate another person’s privacy, intellectual-property, contractual, or other rights
- The materials are not knowingly false, unlawful, malicious, or misleading
- Files do not knowingly contain malware or harmful code
You grant Criterion a limited, nonexclusive right to use, copy, store, process, and share those materials only as reasonably necessary to:
- Evaluate or provide requested services
- Prepare and maintain inspection records
- Communicate with you and authorized parties
- Operate and secure the Website
- Meet professional, contractual, insurance, and legal obligations
- Establish, exercise, or defend legal rights
You retain any ownership rights you otherwise possess in your materials.
10. Inspection Reports and Evidence
Inspection reports, photographs, videos, measurements, findings, and supporting materials reflect conditions observed within the agreed scope, at the inspection location, and at the time of inspection.
Conditions may change after the inspection. Hidden, inaccessible, intermittent, dismantled, disconnected, or otherwise untestable conditions may not be identified.
Reports and evidence are prepared for the customer identified in the applicable agreement. Sharing or relying on them outside the agreed purpose may remove important context, limitations, and qualifications.
You should review and redact VINs, license plates, addresses, personal documents, or other identifying information before publicly posting inspection materials.
11. AI-Assisted Features
Criterion may use artificial-intelligence tools to assist with internal drafting, organization, or quality-review workflows.
AI-generated material:
- Is treated as a draft
- Must be reviewed by Criterion personnel
- Does not replace the inspector’s observations or professional judgment
- Does not independently determine inspection results
- Does not expand the inspection scope
- Is not a completed inspection report unless reviewed and issued by Criterion
You may not treat an unreviewed draft, preview, placeholder, or system-generated message as a final Criterion report.
12. Acceptable Use
You may not use the Website to:
- Access another person’s account or records without authorization
- Misrepresent your identity or authority
- Submit false, fraudulent, or misleading information
- Upload malware, destructive code, or unlawful material
- Probe, scan, or test system vulnerabilities without written authorization
- Circumvent authentication, access controls, payment controls, or completion safeguards
- Interfere with the Website or another user’s access
- Scrape, copy, or extract Website content through automated means without permission
- Reverse engineer or attempt to derive nonpublic source code
- Use Criterion’s name, reports, photographs, or branding deceptively
- Violate applicable law or another person’s rights
Criterion may restrict or terminate Website access for suspected misuse.
13. Intellectual Property
The Website and its original content, design, software, reports, forms, graphics, photographs, branding, and documentation are owned by Criterion or used under authorization and are protected by applicable intellectual-property laws.
“Criterion RV Verification,” Criterion logos, and related brand elements may not be used without written permission.
References to NRVIA and other third-party names or marks remain the property of their respective owners. Their appearance does not transfer ownership or grant you permission to use them.
You may download or print materials provided to you for your personal or authorized business use. You may not reproduce, sell, publicly distribute, remove attribution from, or commercially exploit Website materials without permission, except as allowed by law or a separate written agreement.
14. Third-Party Services and Links
The Website may use or link to services operated by third parties, including payment, electronic-signature, hosting, authentication, storage, email, laboratory, mapping, or AI providers.
Criterion does not control every aspect of third-party services. Their availability, security, and handling of information may be governed by their own terms and privacy policies.
A link or integration does not necessarily constitute Criterion’s endorsement of all third-party content, products, or practices.
15. Website Availability
Criterion attempts to maintain reliable Website access but does not guarantee uninterrupted or error-free operation.
The Website may be unavailable because of:
- Maintenance
- Updates
- Provider outages
- Internet or utility failures
- Security incidents
- Events outside Criterion’s reasonable control
Criterion may modify, suspend, or discontinue Website features when reasonably necessary. Service records and contractual obligations remain governed by the applicable agreement and law.
16. Website Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
CRITERION DISCLAIMS WARRANTIES CONCERNING THE WEBSITE’S UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, OR FITNESS OF GENERAL WEBSITE CONTENT FOR A PARTICULAR TRANSACTION OR DECISION.
THIS WEBSITE DISCLAIMER DOES NOT REPLACE OR ALTER ANY EXPRESS OBLIGATION IN A SIGNED SERVICE AGREEMENT AND DOES NOT WAIVE RIGHTS OR WARRANTIES THAT CANNOT LAWFULLY BE WAIVED.
17. Limitation of Liability for Website Use
To the maximum extent permitted by law, Criterion is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of, or inability to use, the Website or general Website content.
Liability relating to an inspection or other paid service is governed by the applicable signed agreement and applicable law.
Nothing in these Terms excludes or limits liability, remedies, warranties, or consumer rights that cannot lawfully be excluded or limited.
18. Responsibility for Misuse
You are responsible for losses or claims resulting from your unlawful use of the Website, intentional violation of these Terms, unauthorized access to another person’s records, or infringement of another person’s rights.
This provision does not require a consumer to waive rights or remedies that cannot legally be waived.
19. Privacy
Our collection and use of personal information are described in the Criterion Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
20. Changes to These Terms
Criterion may update these Terms to reflect changes in the Website, services, technology, business practices, or law.
Updated Terms will be posted with a revised effective date. Material changes may also be communicated through the Website, portal, or another reasonable method.
Changes do not retroactively alter a signed service agreement unless the parties agree in writing or applicable law provides otherwise.
21. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute relating to a paid service remains subject to the governing-law, venue, dispute-resolution, limitation, and other provisions of the applicable signed agreement.
For a Website-only dispute not governed by a signed agreement, jurisdiction and venue will be determined under applicable law.
22. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
Criterion’s failure to enforce a provision on one occasion does not waive its right to enforce that provision later.
23. Entire Website Agreement
These Terms and the Privacy Policy constitute the agreement governing general Website use.
They do not replace a quote, Pre-Inspection Agreement, Standards of Practice, subscription agreement, payment authorization, or other service-specific contract.
